LEGION POST 162
HOUSE
RULES
ARTICLE I
GENERAL
A. Applicable Statutes
and regulations
1. Statutes and
licensing requirements of the Commonwealth of Virginia, the Virginia
Charitable Gaming Commission, county of Fairfax and other government
agencies having jurisdiction.
2. Administrative
implementation of the provisions of the Post Constitution and Bylaws
by the Post Membership and/or Executive Committee.
3. Other legally
approved motions and resolutions of the Post Membership and or
Executive Committee.
B. Amendments
1. The Post House
Committee shall review the House Rules at least annually and
recommend changes to the Post Executive Committee.
2. Any part of the
policies and procedures contained herein is subject to change
without notice, except where notice is prescribed by the Post
Constitution and Bylaws, or by approval of the Post Executive
Committee.
C. The facilities of the
Post Home are made available for the following purposes:
1. The conduct of
official American Legion programs and activities (meetings, veterans
programs and projects, patriotic holiday observances, etc.).
2. Post fund raising
activities (bingo, dances, dinners, hall rentals, etc.)
3. As a community
facility for use by civic, youth and other nonprofit organizations
subject to the approval of the House Committee.
4. As a social center
for all members. The American Legion is a family organization and
the Club Room atmosphere will reflect a family orientation in which
all members of the Legion family will be able to feel comfortable.
D. The image of American
Legion and of Post 162 and our reputation within the community is of
paramount importance and requires proper conduct on the part of members,
guests, and visitors. The use of the Club Area of the Post Home is a
privilege and is subject to probation, suspension or revocation for
conduct not in keeping with that image.
E. All provisions of the
Virginia Alcoholic Beverage Control Board (ABC) and the Virginia
Charitable Gaming Commission are to be complied with by all members,
guests, and employees.
ARTICLE II Definitions
Section 1. Member, as
applies to the House Rules, shall mean any Legionnaire, American Legion
Auxiliary, or Son of the American Legion member in good standing of
Lorton Post 162. A member in good standing is defined as one who has
paid his/her annual dues by 1 January of the applicable year.
Section 2. Visiting
member is defined as any person that is a member in good standing of any
other American Legion Post or their subordinate organizations.
Section 3. Club Room or
Social Quarters is that portion of the Post Home housing the bar
facilities.
Section 4. Post Home
includes all the premises and grounds utilized by Post 162, including
any building (s) thereon.
Section 5. House
Committee is the committee appointed by the Commander with authority
from the Executive Committee to oversee the operation of the Club.
Section 6. Management, as
applied to the House Rules, shall refer to the Operations Manager, the
ABC Manager on duty, and the House Committee.
Section 7. Minor is any
person declared a minor within the meaning of the Virginia State ABC
laws.
Section 8. Guest is
anyone who is not a member of Post 162, American Legion Auxiliary, and
Sons of the American Legion or a member of any other Post, Unit or
Squadron.
Section 9. Food Service
Manager is any person certified in accordance with the requirements of
the Fairfax County Health Authority, and who has a valid Food Handlers
Certificate. This person is responsible for enforcing the Food Service
Regulations of Fairfax County.
ARTICLE
III Admittance
A. Except as stated
elsewhere in these House Rules, no person shall be permitted in the Club
Room who is not a member in good standing in this Post, or another Post
of the American Legion, American Legion Auxiliary, or the Sons of the
American Legion.
B. Members entering the
club area will show the ABC Manager on duty a current membership card or
a receipt showing dues paid for the current year. Members who have not
paid their dues to their respective organizations by January 1 may not
be admitted to the club.
C. Except for guide or
leader dogs, no pets are allowed within the Post Home or Club Room at
any time.
D. No one under the age
of 18 will be admitted to the Club Room without a parent, guardian or
Responsible adult.
ARTICLE IV
Guests
A. All quests will be
registered in the guest register controlled by the ABC Manager on duty
and located behind the bar. The number of guests registered is left to
the discretion of the Operations Manager, or the ABC Manager on duty
B. Sponsors will at all
times be responsible for the conduct of their guests, and any violation
of these rules by a guest will be considered a violation by the member.
C. When a guest's sponsor
leaves the club area, the guest is also required to leave. Sponsors who
depart for short periods (30-minutes or less) may, with ABC Manager
acting as temporary sponsor, let the guest remain on premises until they
return).
D. Individuals attending
a private rental function are required to remain in the physical
confines of the area rented for the occasion
ARTICLE V
Conduct & Discipline
A. Any event or action,
mechanical, electrical or behavioral that disrupts the normal operations
of the Club or causes a crisis is considered an incident. Mechanical and
electrical examples of these are; power failure, failure of AC/heating
unit, broken or busted door locks, unsanitary conditions, and safety
related issues. Some examples of behavioral misconduct are: Failure to
comply with the House Rules; excessive profanity, vulgarity, overt
discrimination based on race, color, religion, etc., physical violence,
and possession or use of any controlled illegal substance as defined by
local state and federal laws (this violation will result in an automatic
suspension of one year).
B. When such conditions
occur the ABC Manager on duty should write out an Incident Report. If
the matter is safety or security related the Operations Manager will be
notified immediately. In-turn the Operations Manager will notify the
Post Commander and Chairman of the House Committee for further
corrective action if appropriate. The ABC Manager on duty must ensure
the written report is in detailed ensuring that the "When, What, Where,
and How" are clearly defined. The report must be turned into the
Operations Manager the next morning. All other non-serious incidents
should be forwarded to the House committee for action.
C. All complaints
concerning the Club, it's management, employees, members and their guest
will be in writing and presented to the Operations Manager, ABC Manager
on duty or any House Committee Member, or Post Official. Complaints
should be given to the General Manager, the Post Commander or the
Chairman of House Committee only. All complaints of discrimination on
the basis of gender, race, religion, etc, of misconduct should be
immediately forwarded to a member of the House Committee. The House
Committee will investigate written reports of violations as quickly as
possible usually within 72 hours. The House Committee will review the
situation, interview witnesses, recommend proposed corrective actions
and notify the individuals involved via letter signed by the Chairman
with a copy to the Adjutant. This letter will identify the issues,
explain the corrective action and provide instructions for an appeal.
D. The ABC Manager on
duty has final authority in the operation of the club area, with respect
to patrons conduct including enforcement of ABC regulations and Post 162
House Rules. The ABC Manager's authority includes refusing service or to
require any member, guest or visiting member to leave the Post Home if
in the judgment of the ABC Manager their conduct or behavior is
unacceptable or in violation of ABC regulations or the House Rules.
E. Members and guests
will not intentionally intrude in areas of the Post Home facilities in
use by private rentals nor interfere with such activities in anyway.
F. The Post Home is
primarily for the use of our members. However, any violation of the
House Rules or Post Regulations by members or guests could result in
probation, suspension, or disbarment, ranging from one month to a
lifetime, depending on the seriousness of the violation.
G. Members who have
suggestions that they believe will improve how we service our membership
or to improve the Post's outreach to the surrounding community should
submit it in writing and present it the ABC Manager on duty.
ARTICLE VI
Appeals
A. Disciplinary letter to
offender will provide Instructions for appeal of House Committee
Decisions.
B. Upon receipt of such
an appeal by the House committee, arrangements will be made for
Executive Committee review. The decision of the Executive Committee
shall be final.
ARTICLE
VII Check Cashing Policy.
A. Check cashing shall be
limited to members and visiting members.
B. Members are limited to
cashing checks totaling $900.00 per day, in increments of $300.00 or
less per check. No one can authorize exceptions. Visiting members are
limited to $50. Limit $100.00
C. Dishonored checks must
be redeemed or arrangement made for payment with the Operation Manager
within 7 calendar days of notification for face value plus any bank fees
imposed. The members name will be inconspicuously displayed behind the
bar and check-cashing privileges will be suspended until the check is
redeemed. Dishonored checks not redeemed within 14 days of notification
will have bank fees and a service charge of $25 added to the original
value of the check. After 14-days and if the check (s), have not been
redeemed, all club privileges will be suspended until the checks have
been redeemed. After 30 days, the checks will be turned over to proper
authorities for collection.
D, No two-party checks,
post dated checks or payroll checks (other than from Post 162) will be
cashed.
E. Guest may not cash
checks
ARTICLE
VIII Service and Beverages
A. The ABC Manager
reserves the right to refuse service to anyone. Absolutely no alcoholic
beverages will be served to a minor.
B. Members, visiting
members, or guest cannot bring alcoholic beverages licensed for sale by
Post 162 (beer and wine) into the club area.
C. Beverages purchased
for off-site consumption will not be opened in the club area and must be
removed from the Post Home following purchase.
D. Open containers of
alcoholic beverages licensed by Post 162 will not be carried out of the
Post Home, except for the fenced-in area known as the Post grounds.
E. Privately owned
alcoholic beverages, which are brought into the Post Home, must be
marked with the first and last name of the owner and kept in the
member's locker, under the bar, or during actual use, behind the bar.
The ABC Manager on duty may only provide service from the container.
F. Upon leaving the
premises members must either place their containers in their rented
lockers, take them out of the Post Home or placed them below the bar.
G. No one may be served a
beverage from another member's container unless the member who owns the
container is physically present in the Club Room and gives permission.
However, the owner of the bottle may put a second name on the bottle if
he wishes to make his bottle available to a second person.
H. During patriotic
observances such as. Flag Day, Independence Day, Memorial Day, and
Veterans Day ceremonies, or any other day deemed appropriate by the
Commander or his representative, the Club Room will be closed to all
members, visiting members, and guests. The bartender on duty will clear
the bar and make sure the Club Room stays vacant until the ceremony is
over.
ARTICLE IX Dress Code
A. The following
standards of dress apply to members, visiting members and guests.
Basically, any clothing deemed inappropriate by management is not
permitted. This would include clothing that is overly suggestive or
revealing or to be in generally bad taste. Management has the authority
to refuse service and request departure from the club area anyone who is
not dressed appropriately.
Any outerwear with
vulgar or offensive slogans
These are not intended to
be all-inclusive. All members and guests are expected to dress so as not
to offend or embarrass any other member or guest.
ARTICLE X Gaming & Entertainment
A. Guests 21 years and
older are permitted to purchase and participate in all pull-tab games.
B. Game winners not
claimed within 30 days of the close of the game become the property of
Post 162.
G. The pool table and
video game devices in the Club Room are for entertainment only and
illegal gambling in any form is not permitted.
H. The jukebox and the
video game machines will not be moved without permission from the owner-
Amusements Unlimited, Inc. The pool table will not be moved.
I. The volume level for
the jukebox and TVs will be adjusted and controlled by management only.
The members, not the ABC managers, will determine program selection. The
manager should try to serve the interests of the majority. Another
program on another TV may be viewed but the volume should be muted or
adjusted.
J. If the jukebox is
being played, the volume on the TV sets should be adjusted or muted. The
ABC Manager on duty should heed the advice of the members and refrain
from selecting viewing material that the members have little or no
interest in watching. On some occasions the jukebox should be turned off
so members can enjoy a specific televised event.
